Terms of use of ATREA aMotion and privacy statement

1.    Home

These are the terms of use (hereinafter referred to as "Terms") of the aMotion mobile application operated by ATREA s.r.o. ("ATREA") and other services provided in connection with this application. aMotion is a mobile application designed for remote control and monitoring of the operation of DUPLEX ventilation units. In these Terms you will also find information about the processing of personal data for the above purposes.

By using ATREA aMotion, you agree to these terms and conditions. Please read these Terms very carefully and only start using aMotion if you are sure you understand and agree to them. ATREA reserves the right to change these Terms of Use at any time in its sole discretion. In the event that we issue new Terms of Use and you continue to use the aMotion App, you will be deemed to have accepted the new Terms of Use.

2.    Functions and use of the app

The aMotion app allows remote control and monitoring of the DUPLEX ventilation unit. As a user, you can monitor the status and warning notifications on the ventilation unit, select and adjust the unit settings, as well as change the parameters used to control the unit and get information about its operation.

As a user, you can also turn the app off and on, change modes and settings (airflow, temperature, etc. - depending on the capabilities of the specific model), set weekly programmes and use the air quality control function. As a user, you can monitor: sensor readings (depending on the equipment of your unit), air flow, temperature, etc. If the unit is connected to the internet and the user gives his/her consent in the unit settings, the software can be automatically updated (removing errors, adjusting the compatibility of the application with the control unit, etc.). Also, the app can be updated automatically if you give your phone permission to do so. For more detailed information about the functions and use of the aMotion app, please refer to the user guides.

3.    Your duties

If you intend to use the ATREA aMotion app, you will need access data for your unit. You will also need to set up an amotion.cloud account using your authentication email address. Please remember the password you create yourself. We recommend that you create an original and therefore secure password that is difficult to guess or find out (i.e. it should not be your name, date of birth, car make or a password you use on another account). We also recommend that you do not share this password with anyone. If at any time in the future you suspect that someone else is using your password, change it immediately.

Using aMotion is completely free and no fees apply. Exceptions to this may be if your mobile operator or internet service provider charges for data transfer.

4.    Rights

The copyright and other rights and content of aMotion are owned by ATREA and as such are protected by law.

The use of the subject matter of these rights for commercial purposes is prohibited without the prior written consent of ATREA. This prohibition also applies to the copying, transmission and sale of information, images, graphs, photographs, graphic solutions, program codes and technical solutions. Circumvention of security measures and systems is strictly prohibited.

Unauthorized use or distribution of the ATREA aMotion application is an infringement of copyright and trademark rights or other rights in rem or otherwise. As such, it may be punishable under both the Civil Code and the Criminal Code.

5.    Installing and logging into the app for the first time

After you install aMotion from GooglePlay or the AppStore, you can start using it right away. First, log in to your cloud account (at amotion.cloud) or create a new account. To do this, you need to have your phone connected to the internet.

To start controlling and monitoring your DUPLEX ventilation unit with aMotion control on your local network, proceed as follows: The unit must be connected via Ethernet cable to the local network. Connect your smartphone to the same network. Open the aMotion app on your mobile phone, search for the unit on the local network and enter the access password (factory set to name: "admin"; password: "pass"), change your access password for security and then use the app as required. In this case, neither the unit nor the phone needs to be connected to the Internet, but both devices must be on the same local network.

To start controlling and monitoring your ventilation unit remotely, do the following: The unit must be connected to the internet with an Ethernet cable and communication with the cloud enabled in the settings. A user account must be set up on the unit with a link to your cloud account (matching email address). Then, when you first launch the mobile app, you just need to enter your cloud account and the first page of the app will show you all the units that you have in your cloud account and that you have enabled to be displayed.

6.    Privacy Statement

6.1.    Categorisation of data and purposes of processing

Below you will find an overview of the data and personal information processed by ATREA:

If the unit is not connected to the Internet and you are connected to the unit locally:
User account details: username (= verification email address) and password


If the unit is connected to the internet and you communicate with it via the cloud:
User account details: username (= verification email address) and password

Information about the product and its use:
    The date when the unit's control board last attempted to connect to the server
    Product serial number
    Current software version
    Data and parameters related to the configuration, control and operation of the unit

The legal basis for the processing of this data is your consent to use the aMotion mobile application.
ATREA does not process any of your personal data.

6.2.    Retention and deletion of data

The data referred to in point 6.1 is stored completely anonymously on ATREA servers, it is only linked to the e-mail address (cloud access name) and the serial number of the unit. This data is stored for 1 year after the last connection of the unit to our cloud and is then securely deleted.

6.3.    Transfer of personal data

ATREA does not send the data it processes to any third party.

Your data will not be passed on to third parties unless you have given your consent, or ATREA is under a legal obligation to pass on the data to third parties, or the data is anonymised.51

6.4.    Additional information

You have the right to access, rectify or delete your data, to restrict the processing and portability of your data, to refuse the processing of your data and to lodge a complaint with the State Office for Personal Data Protection. Requests for the exercise of your rights should be sent to the email address provided (amotion.support@atrea.cz) or to the ATREA office.

6.5.    End of data collection

If you wish to stop using the aMotion App or cancel the periodic collection of data about your device described in Section 6.1, you may do so at any time. Simply uninstall the app from your phone and send an email requesting cancellation of your cloud account to: amotion.support@atrea.cz

We will terminate your account and all data collected from the aMotion app and your device data will be securely deleted from ATREA's server.

If you are transferring ownership of the entire Device to another person, you must inform them of these aMotion Terms of Use

7.    Sending notifications and preventing access to the app

ATREA reserves the right to prevent you from accessing the aMotion application. In such event, ATREA will notify you 90 days in advance that it plans to terminate your access to the aMotion Services or make significant changes to the aMotion Program. ATREA also reserves the right to disable or restrict your access to aMotion if you violate these Terms of Use.

8.    Declaration of cases where ATREA is not legally liable

Your phone must have access to the internet for the aMotion App to function properly and without error in accordance with these Terms. In exceptional cases, the aMotion application may be unavailable due to, for example, a software update, internet connection failure or other technical problems.

ATREA will use its best efforts to ensure that aMotion is protected from viruses and other electronic threats at all times, but cannot guarantee this. You are responsible for installing and maintaining antivirus software and other security measures on your phone, as well as backing up your data.

If you receive an error message or notice any defect, please notify ATREA. If the aMotion application can no longer function as the user would expect, ATREA shall not be held liable for any direct or indirect losses suffered by you or third parties as a result.
